Terms of Service

These Terms of Service ("Terms") govern your use of the MyPetHQ mobile application and website (the "Service") operated by MyPetHQ ("we", "us", or "our"). By using the Service, you agree to these Terms.

1. Use of the Service

MyPetHQ provides tools for pet sitters, groomers, and their clients to manage bookings, pet profiles, invoices, communications, and payments. You agree to use the Service only for lawful purposes and in accordance with these Terms.

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.

2. Accounts

You are responsible for maintaining the security of your account and password. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account.

You may be required to enable two-factor authentication (2FA) to access certain account features or the Service generally. If you enable 2FA, you are responsible for securely storing your backup codes. We cannot recover your account if you lose access to both your authentication method and your backup codes.

3. Subscription and Billing

MyPetHQ offers a free plan and a Pro plan at $9.99/month. The Pro plan includes a 7-day free trial for new subscribers.

  • Subscriptions are billed monthly through the Apple App Store or Google Play Store.
  • You may cancel your subscription at any time through your device's subscription management settings.
  • Cancellation takes effect at the end of the current billing period.
  • We do not offer refunds for partial billing periods.
  • From time to time, MyPetHQ may grant complimentary Pro access (for example, to beta testers) outside of the App Store or Play Store billing system. Complimentary access does not affect, and is not affected by, any separate paid subscription you may hold.

4. Payments Between Providers and Clients

MyPetHQ offers providers several ways to accept payment from clients for their services:

  • Card payments: Providers may connect a Stripe account to accept card payments directly through the app. Card payment processing is provided by Stripe, Inc.; MyPetHQ does not collect, process, or store card information. In this arrangement, the provider — not MyPetHQ — is the merchant of record for the transaction. The provider remains responsible for responding to and providing evidence for any payment dispute or chargeback on their connected account, and for Stripe's own processing fees on that transaction. Stripe bears the risk of loss for any unrecoverable negative account balance resulting from a dispute or chargeback — that loss is not the responsibility of the provider or of MyPetHQ. MyPetHQ deducts a flat $0.50 application fee from the provider's payout on each card payment processed through MyPetHQ's Stripe integration, automatically at the time of processing, in addition to Stripe's own processing fee (currently 2.9% + $0.30 per transaction, set by Stripe and subject to change by Stripe, not MyPetHQ). This fee is not charged to the client and does not change the amount the client pays. Providers who do not wish to pay this fee may decline to connect a Stripe account and instead accept payment via Cash App, Venmo, PayPal, or cash — none of which carry any MyPetHQ fee.
  • Cash App, Venmo, and PayPal: Providers may link a Cash App, Venmo, or PayPal handle. MyPetHQ generates a pre-filled payment link for the client's convenience but is not a party to, and has no visibility into or responsibility for, transactions made through these third-party services. Providers are solely responsible for confirming they've received payment before marking an invoice as paid.
  • Cash and other arrangements: Providers and clients may also arrange payment directly, outside the app, entirely at their own discretion.
  • Provider cancellation and refund policies: A provider may set their own cancellation and refund policy, shown to clients before paying by card. This policy is an agreement between the provider and client. MyPetHQ does not mediate, enforce, or guarantee any provider's cancellation or refund policy, and is not responsible for disputes arising from it.
  • Prohibition on passing card fees to clients: Providers are prohibited from adding Stripe's processing fee, MyPetHQ's application fee, or any other surcharge to a client's invoice because the client is paying (or may pay) by card. The invoice amount must be the same regardless of how the client chooses to pay. Violating this rule may result in a warning, and repeated or continued violations may result in suspension or termination of the provider's MyPetHQ account.

5. User Content

You retain ownership of all content you upload to the Service, including pet photos, care notes, and business information. By uploading content, you grant us a limited license to store and display that content solely to provide the Service.

You are solely responsible for the content you upload. You agree not to upload content that is unlawful, harmful, or violates the rights of others.

If you leave a review for a provider, you may choose to post it anonymously. If you do not choose to be anonymous, your name will be visible on your review, which is publicly viewable on our website. Providers may not manipulate, purchase, or solicit reviews in violation of these Terms.

A provider's general location (city and state) and reviews are shown publicly to help clients find and evaluate providers.

6. Provider and Client Relationships

MyPetHQ facilitates communication, scheduling, and payment between pet service providers and their clients. We are not a party to any service agreement between providers and clients, including the quality, timeliness, or performance of pet care services, or any payment or refund disputes between them. Any such disputes are solely the responsibility of the provider and client involved.

7. Limitation of Liability

To the fullest extent permitted by law, MyPetHQ shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including damages related to payments made or received through the Service, whether by card, Cash App, Venmo, PayPal, or cash. Our total liability shall not exceed the amount you paid to MyPetHQ (excluding amounts paid to providers) in the 12 months preceding the claim.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, and we do not warrant the accuracy of any provider's location, availability, reviews, or payment handles.

9. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time directly within the app under Settings, or by contacting us at support@mypethq.app.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via the app or email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the applicable jurisdiction.
